How to Challenge a Dubai Service Charge: The Escalation Path

Your service charge jumped and nobody will explain why. The escalation route from management company to RERA, which arguments work, and what non-payment costs.

Residential development, Dubai

Service charges are the largest recurring cost of owning Dubai property and the one owners have least control over. When the invoice arrives 40 percent above last year with no explanation attached, the instinct is to complain loudly and pay late. Both are the wrong move, and the second one is expensive.

This page is about what to do when you think a charge is wrong: how to test it, who to escalate to in what order, which arguments actually land, and what non-payment costs you. What the charge is and how it is set is covered on the service charge index page.

Insider tip: before you argue about the rate, check the area on your invoice against the suable area on your title deed, because a unit billed on marketing area rather than title area can be over-charged by 10 to 15 percent every year and that error is corrected in a fortnight rather than fought for a year.

What are you actually being charged for in Dubai?

The invoice covers your unit’s share of the approved annual budget for the jointly owned property, calculated as a rate per square foot applied to your unit’s area. Budgets for jointly owned property in Dubai require Real Estate Regulatory Agency approval before they are billed, and the funds are collected through the Mollak system into an escrow account for that project.

That structure is the reason a challenge is possible at all. In an unregulated market an owner arguing about a service charge is arguing about opinion; in Dubai the owner is comparing an invoice against an approved figure and an audited account. The typical bill separates a general fund covering day-to-day operation, a reserve fund for major replacement such as chillers, lifts and facade works, and in many towers a district cooling charge that may be billed by a separate utility provider entirely. Rates across the market run from roughly AED 6 per square foot in older low-rise communities to AED 55 in branded residences, and the spread within a single community can exceed AED 8 per square foot between a well-run tower and a poorly run one. Knowing which component moved is the first diagnostic step: a reserve fund contribution rising to fund a scheduled chiller replacement is legitimate, while a general fund rising with no change in service is not.

When is a Dubai service charge actually wrong?

A charge is wrong when it fails a process test, not when it feels high. A rate above the community norm that was properly approved and properly spent is expensive rather than improper, and a complaint framed that way goes nowhere.

The grounds that carry weight are specific: being billed above the approved rate for the budget year, being charged for works that do not appear in the approved budget, having the rate applied to an incorrect unit area, a management company that cannot produce audited accounts on request, or funds that are not being held in the regulated escrow account for the project. Each of those is a factual question with a documentary answer, and 2 of them, the area error and the rate mismatch, can be proved from documents you already hold, which is what makes them winnable. There is also a category that sits between the two: a budget approved on assumptions that have since proved wrong, such as an occupancy forecast that never materialised, which is not improper but is a legitimate subject for the owners committee to press at the next budget cycle rather than a matter for the regulator today.

How do you check your charge against the approved budget?

Checking takes an afternoon and settles most disputes without escalation, because the great majority of service charge complaints in Dubai turn out to be one of 3 documentary errors rather than a dispute about the budget itself. Work through four documents in order, and request the ones you do not have in writing rather than by phone, so that the request itself is dated evidence if you later need to escalate.

  1. Your title deed, for the suable area. This is the number the rate should be applied to.
  2. The current invoice, for the rate per square foot, the area used, and the split between general fund, reserve fund and any separately billed cooling.
  3. The approved budget for the current year, requested from the management company. Approved figures are also published through the Dubai Land Department service charge index and visible in the Dubai REST application.
  4. The audited statement of account for the prior year, which shows whether last year’s budget was actually spent as approved.
What you compareWhat a discrepancy usually means
Invoice area against title deed areaBilling on marketing area, a 10-15% over-charge
Invoice rate against approved rateBilling above approval, a direct process breach
Line items against approved budgetWorks charged outside the approved budget
Prior-year spend against prior-year budgetUnder-delivery, or a case for the next budget
Opening balance against your payment recordArrears carried from a previous owner

What is the escalation path, step by step?

Escalate in order and keep every step in writing, because each of the 5 stages below assumes the previous one has been exhausted, and a complaint that skips a step is usually returned to it with weeks lost. Allow roughly 2 weeks between stages, which is long enough to be reasonable and short enough to show you pressed.

  1. Written request to the management company for the approved budget, the audited accounts and a breakdown of your invoice. Give a reasonable deadline and record it.
  2. Written challenge to the management company setting out the specific discrepancy, with the documents attached. Most legitimate errors are corrected at this stage.
  3. Escalation through the owners committee, which can require explanation of budget lines and can aggregate the same complaint across many units.
  4. Formal complaint to the Real Estate Regulatory Agency and the Dubai Land Department, citing the approval and audit failure rather than the size of the charge.
  5. Judicial route where the regulatory route does not resolve it. Dubai has routed certain jointly owned property disputes to the Rental Disputes Centre rather than the ordinary courts, so confirm current jurisdiction with the Land Department before filing.

What can an owners committee actually do?

An owners committee has a supervisory and consultative role, not management control. It can require the management company to explain and justify budget lines, raise concerns with the regulator, and coordinate owners so that one documented complaint speaks for a large share of the building.

What it cannot do is the part owners most often assume. It cannot unilaterally set the budget, dismiss the management company, or refuse to approve a charge, and a committee that presents itself as able to do those things is overstating its position. Its real leverage is informational and collective: a management company facing a committee that has read the audited accounts and can show 60 units raising the same documented discrepancy behaves differently from one facing a single annoyed owner. That leverage is at its strongest during the budget consultation for the following year rather than after an invoice has been issued, which is the single most underused window in the whole process.

Which arguments work and which waste your time?

Sort your complaint into the two columns below before writing it, because a strong argument sent alongside a weak one is read at the strength of the weak one. Of the 6 grounds on the left, the area error and the rate mismatch resolve fastest, often within 2 weeks, because neither requires anyone to accept a judgement call.

Arguments that workArguments that waste time
Rate billed above the approved rateThe rate is higher than the tower next door
Charge applied to marketing area, not title areaService quality feels worse than last year
Works billed that are absent from the approved budgetThe developer promised a lower figure at sales
Audited accounts not produced on requestOther owners are also unhappy
Funds not held in the regulated escrow accountThe charge is unaffordable for me personally
Arrears from a previous owner billed to youThe building was cheaper five years ago

The left column is documentary and the right column is subjective. Where a genuine quality problem exists, the route is the budget consultation and the owners committee, not a challenge to an invoice that was correctly calculated from an approved budget.

What happens if you simply stop paying?

Non-payment is the weakest available position and it costs more than the disputed amount. Arrears accrue against the unit, the management company can pursue recovery, and unpaid service charges block the no objection certificate required to complete a sale.

That last consequence is the one that decides most cases. An owner who withholds AED 18,000 of disputed charge and then decides to sell 14 months later finds the transfer stalled at the NOC stage, with the buyer’s deposit at risk and the balance now larger for the delay. The dispute has also changed character: it is no longer about whether the charge was properly approved, it is about your default, and the management company’s position has improved without them doing anything. Pay under written protest, stating in the payment reference and in a covering email that payment is made without prejudice to the challenge, and then pursue the challenge on its own timeline rather than the invoice’s. The resale mechanics that the NOC sits inside are covered on the selling property in Dubai guide.

How much can a successful challenge recover?

Recovery is usually a correction going forward plus a credit for the period the error ran, and the amounts are meaningful on a long hold. An area error of 12 percent on a 1,100 square foot unit billed at AED 16 per square foot is roughly AED 2,100 a year, so a three-year error is AED 6,300 before the correction takes effect.

The larger recoveries come from budget-line challenges rather than area errors. Where works billed outside the approved budget are removed and the general fund is reset, the per-unit effect can be several thousand dirhams annually across every unit in the building, which is why collective challenges through the owners committee produce better outcomes than individual ones. Set expectations honestly though: most challenges end as a corrected invoice and a modest credit rather than a refund cheque, and the real return is the 5 or 10 years of correct billing that follow the correction. Against a purchase where closing costs alone run about 6.5 percent of price, as set out on the cost of buying page, a permanent AED 2,000 a year correction is worth more than it first appears.

What should you check before you buy into a building?

Every dispute on this page is cheaper to avoid than to run. Five checks before you commit, all of which the seller or agent can produce, and none of which takes more than a phone call to obtain.

  • The approved rate per square foot for the current year and the two prior years, to see whether the building has repriced.
  • The audited accounts for the prior year, to see whether the budget was spent as approved.
  • The reserve fund balance and the age of the major plant, because a chiller or lift replacement due in two years is a step change waiting to happen.
  • A clearance statement confirming no arrears attach to the unit, obtained before the trustee appointment rather than after.
  • Whether district cooling is inside the service charge or billed separately, since a low headline rate with a separate cooling bill is not a low total.

Frequently Asked Questions

Yes. Service charge budgets for jointly owned property in Dubai must be approved by the Real Estate Regulatory Agency before they are billed, and they are invoiced through the Mollak system against an audited escrow account. That approval and audit trail is what makes a challenge possible: you are testing the invoice against an approved budget rather than arguing about whether the charge feels high.

Request the approved budget and the audited statement of account from the management company in writing, and compare the rate per square foot you are billed against the approved figure and your title deed area. Most disputes end here, because the discrepancy is usually an area error, a district cooling item billed separately, or an arrears balance carried from a previous owner.

No. A rate that is high relative to other buildings is not a ground for challenge if the budget was properly approved and the money was spent as budgeted. Challenges succeed on process and evidence: billing above the approved rate, charging for work outside the budget, an incorrect unit area, missing audited accounts, or funds not held in the regulated escrow account.

An owners committee has a supervisory and consultative role rather than management control. It can require the management company to explain and justify budget lines, raise concerns with the regulator, and coordinate owners so that a single documented complaint carries the weight of many units. It cannot unilaterally set the budget, replace the management company or refuse to approve a charge.

Non-payment is the weakest position available. Arrears accrue against the unit, the management company can pursue recovery, and unpaid service charges block the no objection certificate you need to sell, which can stall a transaction entirely. The stronger route is to pay under written protest while the challenge runs, so the dispute is about the charge rather than about your default.

Approved service charge figures for Dubai jointly owned property are published through the Dubai Land Department's service charge index and are visible in the Dubai REST application. Compare the published rate per square foot for your project and the current budget year against the rate on your invoice, and against the suable area recorded on your title deed rather than the marketing area.

This is one of the most common billing disputes and it is why arrears are checked before transfer. Outstanding service charges attach to the unit in practice, so a buyer who completes without confirming a clear balance can find historic arrears on the first invoice. Request a clearance statement from the management company before the trustee appointment, not after.
